JCC Awards TTD, Penalties, and Fees but Denies Treatment Claims

In Julian Andres Rincon v. Switch Solar/Conexsol Orlando, LLC, OJCC Case No. 22-030281LMS, Judge Lourdes M. Sancerni addressed petitions seeking TTD and TPD benefits, multiple hospital and rehabilitation treatment requests, penalties and interest, and attorney’s fees and costs after the claimant’s 2022 rooftop fall.

Relying on claimant IME testimony from Dr. Richard Smith and no contrary medical evidence, the JCC found the claimant remained on a no-work status and awarded TTD from April 30, 2025 through the June 9, 2026 final hearing, plus penalties and interest, while denying TPD for the same period.

The order denied the requested Orlando Health and AdventHealth treatment because the claimant did not prove the specific treatment and dates of service at those facilities, but it awarded attorney’s fees and costs tied to the August 12, 2025 petition for benefits.
