JCC Awards Mileage but Denies TTD and Dermatology Care in Scabies Claim

In Casey Nicole Lythgoe EL v. Darcy Hall of Life Care/Life Care Centers of America/Gallagher Bassett Services, Inc., OJCC Case No. 26-000496BKC, the claimant sought TTD, reimbursement for dermatology, telehealth, prescriptions, Concentra charges, decontamination costs, ongoing dermatology care, mileage, and a determination that she had not reached MMI after a workplace scabies exposure.

Judge Barbara K. Case found the employer/carrier accepted the scabies exposure as compensable, but the claimant did not carry the evidentiary burden for most disputed benefits. The order denied the dermatology and emergency-care reimbursement claims because the claimant did not present admissible medical evidence, such as an IME or authorized-provider opinion, establishing that the unauthorized Water's Edge Dermatology care was compensable, medically necessary, or emergency treatment under the self-help and emergency-care rules.

The JCC also denied TTD, MMI relief, prescriptions, Concentra copay reimbursement, penalties, interest, and home or vehicle decontamination costs. The only granted benefit was medical mileage for travel to the authorized Concentra treatment visits, with the amount left for administrative handling and jurisdiction reserved if the parties cannot agree.
