JCC Awards TPD and Neck Treatment After Rejecting Notice Defense
In Michael J. Ferrell v. Relogistics Services LLC/Twin City Fire Insurance Company, OJCC Case No. 25-027361WRH, Judge William R. Holley addressed a forklift-pallet accident dispute over notice, temporary disability benefits, and authorization of care for claimed head and neck injuries.
The JCC found the claimant timely reported the October 3, 2025 accident to his on-site supervisor, rejected the employer/carrier's notice defense, and accepted IME testimony that the accident was the major contributing cause of the claimant's cervical injury, radiculopathy, and chronic neck pain.
The order awards temporary partial disability benefits from October 3, 2025 forward, authorizes an appropriate specialist to evaluate and treat the claimant's head and neck injuries, and grants penalties, interest, and claimant attorney's fees, but denies temporary total disability because the record did not prove a no-work status.
